Trump’s legal team filed a friend-of-the-court brief requesting the justices pause TikTok’s ban, due to go into effect on January 19, to give the president-elect time to negotiate a deal to keep the platform operating in the United States. TikTok’s troubles began earlier this year when bipartisan lawmakers grew concerned over its Chinese ownership. Critics argued that ByteDance, TikTok’s parent company, could misuse American user data or allow Beijing to meddle in U.S. affairs.
Congress passed, and President Biden signed, legislation demanding that TikTok sell its U.S. operations or face a ban. While the law gave TikTok 270 days to comply, the clock is ticking, and the app remains in legal limbo.
Trump’s legal team isn’t taking sides in the larger dispute, but they are calling for a pause. Their argument? The ban not only threatens First Amendment rights, but also risks setting a dangerous global precedent.
After all, if the U.S. can shut down a social media platform, what’s to stop other countries from doing the same? Trump’s team points to Brazil’s temporary ban on X (formerly Twitter) as an example of how such actions could spiral out of control.
“The First Amendment implications of the federal government’s shuttering of a social media platform used by 170 million Americans are sweeping and troubling,” Trump’s legal brief states.
It argues that a nationwide shutdown of TikTok would harm Americans’ freedom of speech while undermining trust in the U.S. government’s ability to address concerns without overreach.
The Biden administration, however, has doubled down on its position. According to the Department of Justice, TikTok’s Chinese ties pose a direct threat to national security.
Officials argue that the platform collects massive amounts of data on American users, which could be exploited for espionage or blackmail by the Chinese Communist Party. They also warn that Beijing could use TikTok to spread disinformation or disrupt the U.S. during a crisis.
These concerns aren’t new. Lawmakers from both parties have raised red flags about Chinese tech companies gaining too much influence in America. But Trump’s approach highlights a critical difference.
He’s looking for a solution that protects Americans without trampling on their rights. By negotiating a deal to keep TikTok running in the U.S., Trump aims to strike a balance between security and freedom.
The Supreme Court’s decision will shape the future of TikTok in America.
